Gold Depot Store Inc., a corporation organized and existing under the laws of the State of Florida, doing business as 'Gold Depot Inc.' the survey division, (hereinafter 'Gold Depot'). These Terms and Conditions (“Terms”) govern your access to, use of, and transactions conducted through the Gold Depot Inc. website located at www.golddepotsurvey.com, our toll-free telephone service, mobile sites, applications, and any other related services (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services. You will be required to confirm your acceptance of these Terms before utilizing any Services. Please also review our Privacy Policy, which describes how we collect and protect your personal information.

Important: Section 18 contains a mandatory arbitration provision and class action waiver, requiring that certain disputes be resolved exclusively through binding arbitration on an individual basis in the State of New York. Eligibility: You must be at least 18 years old to use our Services. The Services are intended solely for U.S. residents.

1. Account Creation and Information

You may browse the Services as a guest or create an account profile by entering survey information into the survey. Profiles or accounts require accurate, current, and complete personal information. By creating an account or joining a survey or polling campaign on behalf of a company, you confirm you have authority to bind that entity to these Terms. You are solely responsible for safeguarding your credentials, ensuring they are secure, and promptly updating your information if it changes. We reserve the right to suspend or terminate profiles or accounts at our discretion. Mobile information will never/not be shared nor sold with third parties/affiliates. No user data or information will be sold or shared ie: marketing/promotional purposes.

2. Suspension and Termination

Gold Depot Inc. may refuse service, cancel accounts, or suspend access to the Services at any time, with or without cause, and without liability to you.

3. Intellectual Property

All content, design, trademarks, and proprietary materials available through the Services are owned by Gold Depot Inc. or its licensors. You may only use the Services for personal, non-commercial purposes, and may not copy, modify, distribute, reverse-engineer, or otherwise exploit our content without prior written consent.

4. Restrictions on Use

You agree not to use the Services for any unlawful purpose, to infringe the rights of others, or to post or transmit harmful, obscene, or defamatory material. You may not attempt to bypass security systems, use automated scraping tools, or disrupt the operation of the Services.

5. Electronic Communications

By using the Services, you consent to receive electronic communications from us, including order confirmations, updates, and legal notices.

6. Messaging Policy

By submitting your information through our website forms and selecting the opt-in checkbox, you consent to receive SMS and/or email communications from Gold Depot Inc. related to surveys, research, and industry updates.

You may opt out of receiving SMS messages at any time by replying with the word STOP. You may also request removal by contacting us directly. Standard message and data rates may apply.

7. Pricing Accuracy & Liability Disclaimer

Our product pricing for our other companies are determined in real time and directly reflect current market conditions. While we take reasonable measures to ensure the accuracy and reliability of our electronic pricing systems, we cannot guarantee that errors will never occur. In the event of an electronic malfunction, technical failure, or system error that results in an incorrect price being displayed or calculated, Gold Depot Inc. shall not be held liable or obligated to honor such errors related to surveys, polling or pricing, or anything related to these Services. We reserve the right to cancel any Survey or polling entries that result in errors and will notify participants of such cancellations promptly.  

8. Fraud Prevention and Compliance

We may cancel or delay any profiles or survey entries if fraud is suspected and will cooperate with law enforcement when necessary. Gold Depot Inc. complies with applicable anti-money laundering (AML) laws and anti-disinformation campaigns and may require additional identification for certain transactions.

9. User Content

If you submit reviews, comments, or other content to us, you grant Gold Depot Inc. a non-exclusive, royalty-free, worldwide license to use that content. You must own the rights to any content you submit and agree not to post illegal, defamatory, or infringing material.

10. Third-Party Links

Our Services do not contain links to any third-party websites. We are not responsible for the content, policies, or practices of any third-party sites.

11. Investment Disclaimer

All investments in precious metals, rare coins (numismatics) involve risk. We do not provide financial or investment advice, and nothing on our Services should be construed as such. You should consult a qualified advisor before making any investment decisions.

12. Disclaimer of Warranties

The Services and products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

13. Limitation of Liability

Our total liability for any claim arising out of your use of the Services or a transaction with us is limited to the greater of $100 or the Purchase Price/Sell-To-Us Price of the product involved.

14. Indemnification

You agree to indemnify and hold harmless Gold Depot Inc. from any claims, losses, or expenses arising out of your breach of these Terms or misuse of the Services.

15. Arbitration Agreement and Class Action Waiver

Any dispute arising from these Terms or related to the Services will be resolved exclusively through binding arbitration in New York, administered under its applicable rules. You waive any right to participate in a class action or jury trial. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to [email protected].

16. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. If arbitration is unenforceable, disputes will be heard exclusively in the state or federal courts located in New York.

17. Miscellaneous

Force Majeure: We are not liable for delays caused by events beyond our control.

Modifications: We may update these Terms at any time, and changes take effect upon posting.

Severability: If any provision is found invalid, the remaining provisions remain in full force.

Entire Agreement: These Terms constitute the entire agreement between you and Gold Depot Inc. regarding your use of the Services.
